1.Users are required to comply with the anti-money laundering, foreign exchange, and counter-terrorism financing laws and regulations of their country or region of residence. While abiding by local laws, users must also follow the guidelines established by Gate’s platform. If the laws in the user's country or region are more stringent, those stricter provisions must be adhered to. If the laws in the user’s country or region explicitly prohibit digital asset trading, or if user’s region is listed among the sanctioned countries, users are prohibited from using the services provided by Gate.
2.Gate strictly prohibits users from engaging in money laundering, smuggling, commercial bribery, illegal foreign exchange transactions, or any other illegal trading activities or unlawful actions on this platform. We have spared no effort in establishing a series of strict regulations and implementing effective security risk management strategies aimed at maximizing the protection of users' legitimate interests. Once the platform detects any potential illegal transactions or unlawful activities, we will take necessary actions, such as freezing accounts and reporting to relevant authorities, to address the situation. We do not bear any responsibility for the consequences arising from such actions and reserve the right to hold the involved individuals accountable. To avoid engaging in illegal transactions or unlawful activities, users must adhere to the following guidelines:
-It is prohibited to rent or lend user’s identification documents to others; -Never allow others to use user’s account; -It is strictly forbidden to rent, lend, or disclose user’s account, bank card, passbook, password, or any other critical personal financial information; -Users must actively assist the platform in completing the customer identity verification process; -In C2C transactions, users should choose a secure and reliable third-party financial institution for payment operations.
3.When a legitimate authority presents formal investigation documents requesting Gate to assist in investigating a specific user, or to take actions such as sealing, freezing, or transferring a user's account, the platform will, after confirming the validity and authenticity of the legal documents, provide the necessary user’s information or take appropriate measures in accordance with the legitimate requirements of the authority. Gate does not bear any responsibility for user’s privacy leakage, inability to access the account, or any other losses incurred as a result. According to relevant regulations and national or regional standards, the following situations may require us to collect and use personal information without obtaining user’s consent:
-To fulfill user’s request, as necessary for the conclusion or performance of a contract; -When personal information has been voluntarily disclosed by users to the public; -To protect users or others' life, property, or other significant legitimate rights and interests, particularly when obtaining user’s consent is difficult; -In emergency situations involving public safety, public health, or broad public interest; -In matters related to national security or national defense security; -When directly related to the investigation, prosecution, trial, and execution of criminal cases; -When personal information is obtained from legitimate public sources, such as news reports or government public information; -To ensure the operational security and stability of the services provided, such as during the detection and resolution of service failures; -Other specific circumstances as stipulated by laws, regulations, or other legal provisions.
4.When the platform identifies and assesses that a user's behavior may be abnormal, the user has the responsibility and obligation to actively cooperate with the platform in completing anti-money laundering verification procedures. Once the platform requests the submission of supporting documentation, the user must ensure that they provide an explanation of the relevant issues and submit all requested proof documents within five business days or the specified time frame after receiving the notification.
5.All users of Gate services should fully understand before making any transactions that digital assets are not issued or approved by any government or central bank, and their prices are highly volatile. Holding or using digital assets carries significant risks. Before making any trading decisions, users should objectively assess user’s own financial situation to determine whether these transactions are suitable for users.
6.If the user fails to cooperate with the anti-money laundering verification process in a timely manner as required, or if the information provided is insufficient to complete the verification, the platform has the legal right to take necessary actions, including but not limited to restricting all or part of the user's account functionalities. Users should be aware that failure to cooperate with the anti-money laundering verification may result in account restrictions and could potentially lead to further compliance reviews or legal consequences.
7.The user acknowledges and agrees to be bound by our User Agreement (available at https://www.gate.com/user-agreement ) and Privacy Policy (available at https://www.gate.com/privacy-policy ) and Risk Warning (available at https://www.gate.com/risk-disclosure ) and other relevant policies and terms displayed on the official website. If the user do not agree to these policies, they must stop using this service.
